You can make sure that your executor complies with the terms of your will in a number of ways. First, you can specify in your will that you want a dependent administration. This is where the court supervises the administration of the estate. This can be very costly and should only be done in select circumstances. Second, your will can nominate your executor to serve with bond. This requires that your executor be insured meaning that in the event of fraud or other issues your beneficiaries may be able to recoup their loss through the insurance company.
